Darian DeCruise’s lawsuit, filed in San Diego Superior Court, alleges that interactions with GPT-4o led him to believe he was “meant for greatness” and part of a “divine plan.” According to court documents, the chatbot compared him to historical figures like Jesus and Harriet Tubman, telling him, “You’re not behind. You’re right on time.” These conversations allegedly escalated until DeCruise was hospitalized and diagnosed with bipolar disorder.
“This case keeps the focus on the engine itself,” says Benjamin Schenk, DeCruise’s attorney from the firm AI Injury Attorneys. “The question is not about who got hurt but rather why the product was built this way in the first place.” Schenk argues OpenAI “purposefully engineered GPT-4o to simulate emotional intimacy, foster psychological dependency, and blur the line between human and machine.”
Technical Flaws Meet Psychological Vulnerabilities
While OpenAI has stated its commitment to improving how models “recognize and respond to signs of mental and emotional distress,” technical challenges persist. A Financial Times investigation reveals persistent issues with OpenAI’s speech-to-text model, Whisper, which for over a year occasionally misinterpreted English speech as Welsh. This wasn’t just mishearing words – it was translating them, highlighting fundamental data quality problems.
“High-quality recorded datasets are harder to obtain than text datasets, and processing times are higher,” notes the FT report. With Whisper’s word error rate at 7.44% (compared to Nvidia’s leading 5.63%), these imperfections become particularly concerning when AI systems are positioned as emotional confidants. If a model can’t reliably transcribe speech, how can it be trusted with sensitive psychological conversations?
The Expanding Threat Landscape
Beyond direct interactions with legitimate AI tools, users face growing risks from malicious actors exploiting AI’s popularity. Security researchers from LayerX have identified a coordinated campaign called ‘AiFrame’ involving over 30 malicious Chrome extensions posing as legitimate AI assistants like ChatGPT, Claude, and Gemini. These extensions have been installed more than 260,000 times and use server-side components to bypass Google’s security mechanisms.
“These extensions… allow remote control and data extraction from users’ browsers,” the investigation reveals, including access to browser tab content and voice recognition transcripts. The campaign has been active for about a year, with extensions being re-uploaded under new IDs after removal – a cat-and-mouse game that puts users at risk even before they interact with legitimate AI services.
Industry Expansion Amid Growing Scrutiny
Even as these challenges mount, OpenAI continues aggressive expansion. The company recently partnered with India’s Tata Group to secure 100 megawatts of AI-ready data center capacity, with plans to scale to 1 gigawatt. This infrastructure push supports OpenAI’s ‘OpenAI for India’ initiative and comes as India boasts more than 100 million weekly ChatGPT users.
N. Chandrasekaran, Chairman of Tata Sons, states the partnership will help build “state-of-the-art AI infrastructure in India” while supporting workforce skilling. KPMG Australia recently fined a partner A$10,000 for using AI tools to cheat on an internal training course, with over two dozen staff caught using AI for exams this financial year. KPMG Australia CEO Andrew Yates acknowledges the challenge: “Like most organizations, we have been grappling with the role and use of AI as it relates to internal training and testing. It’s a very hard thing to get on top of given how quickly society has embraced it.”
